This website is owned by the National Dahlia Society a UK registered charity and is for the delivery of information, advice, membership of the society and various Goods associated with dahlias and the Society activities and charitable Aims and Objectives.

By purchasing goods and services from www.dahlia-nds.co.uk you enter a legally binding agreement with us on the following terms. You should read and understand these terms because they affect your rights and liabilities. These terms describe the basis for purchase by you and sale by us of the products and services described on this web site.

1. Definitions and interpretation

In these terms the following words have the following meanings.

Contract – The contract for the sale and purchase of the Goods and Services.

Delivery Area – Currently delivery to any country is available.

Goods – The range of membership, products and services which are available for purchase from our web site in accordance with the terms.

Site – Our presence on the world wide web, currently accessible via the address www.dahlia- nds.co.uk.

Seller, we, our, or us – National Dahlia Society, ‘Woodside’, Warwick Road, Chadwick End, Solihull, West Midlands, B93 0BP.

We do our best to ensure that the information on the Site is complete, accurate and current. Despite our efforts, however, information on the Site may occasionally be inaccurate, incomplete or out of date. All specifications, memberships, products, services, descriptions and prices of memberships, products and services on the Site are subject to change at any time without notice. We make all reasonable efforts to accurately display the attributes of our memberships, products and services, including applicable colours. We reserve the right to discontinue any membership, product or service at any time.

3. Terms of Sale

In becoming an NDS member or making a purchase, I agree to the NDS using my details to process my membership or purchase and to provide me with membership services and manage my membership.

The NDS will also keep in touch with you to share news, and special offers relating to events, membership, products, services and fundraising. We’ll never sell your data to any third party as we respect your privacy.

You can unsubscribe from mail, emails or phone calls at any time by contacting june.nash@dahlia-nds.co.uk or calling 01564 7845610 (we’re open weekdays 9am to 5pm, excluding bank holidays).

The services offered with membership are described below, however we may, from time to time, change these.

3.1 Memberships for Sale

By purchasing membership from www.dahlia-nds.co.uk you enter a legally binding agreement with us on the following terms. You should read and understand these terms because they affect your rights and liabilities. These terms describe the basis for purchase by you and sale by us of the memberships described on this web site.

We offer 5 types of Membership via the Site:

  • Friend
  • Standard
  • Premium Single
  • Premium Joint
  • Society

The services offered for each are described below, however we may, from time to time, change these.

3.1.1 Friend

  • Quarterly email updates: keep up-to-date with events, news, offers and find out what’s new
    at NDS online when you register your email address.

3.1.2 Standard

  • Membership applies for twelve calendar months from the date of joining.
  • Quarterly email updates: keep up-to-date with events, news, offers and find out what’s new at NDS online when you register your email address.
  • Membership of the NDS: able purchase NDS Goods at the NDS Membership discount rate, able to view on-line the NDS Winter Bulletin and NDS Summer Annual which are produced
    once a year.
  • Membership renewal e-mails will be sent.
  • Membership renewal can be either by Direct Debit or by credit card payment.

3.1.3 Premium Single

  • Quarterly email updates: keep up-to-date with events, news, offers and find out what’s new at NDS online when you register your email address.
  • Membership of the NDS: able purchase NDS Goods at the NDS Membership discount rate, able to view on-line the NDS Winter Bulletin and NDS Summer Annual which are produced once a year.
  • Option to receive a hard copy of the NDS Winter Bulletin and NDS Summer Annual which are produced once a year via post.
  • Can enter either of the two National Shows – Wisley and Harrogate.
  • Receive an NDS membership card which will enable reduced entry to the two National Shows – Wisley and Harrogate.
  • For new members joining after 1st August 2019 membership applies for twelve calendar months from the date of joining.
  • For existing members who joined before 1st August 2019 membership applies for twelve calendar months from the 1st November each year.
  • Membership renewal e-mails will be sent.
  • Membership renewal can be either by Direct Debit or by credit card payment.

3.1.4 Premium Joint

Membership will be for two people at the same address. The main member will receive:

  • Quarterly email updates: keep up-to-date with events, news, offers and find out what’s new at NDS online when you register your email address.
  • Membership of the NDS: able purchase NDS Goods at the NDS Membership discount rate, able to view on-line the NDS Winter Bulletin and NDS Summer Annual which are produced once a year.
  • Option to receive a hard copy of the NDS Winter Bulletin and NDS Summer Annual which are produced once a year via post.
  • Receive an NDS membership card which will enable reduced entry to the two National Shows – Wisley and Harrogate.
  • Can enter either of the two National Shows – Wisley and Harrogate.
  • For new members joining after 1st August 2019 membership applies for twelve calendar months from the date of joining.
  • For existing members who joined before 1st August 2019 membership applies for twelve calendar months from the 1st November each year.
  • Membership renewal e-mails will be sent.
  • Membership renewal can be either by Direct Debit or by credit card payment.

The other member will receive:

  • Receive an NDS membership card which will enable reduced entry to the two National Shows – Wisley and Harrogate.
  • Can enter either of the two National Shows – Wisley and Harrogate.

3.1.5 Premium Society

Membership will be for an Affiliated society to the NDS. The Affiliated Society representative will receive:

  • Quarterly email updates: keep up-to-date with events, news, offers and find out what’s new at NDS online when you register your email address.
  • Membership of the NDS: able purchase NDS Goods at the NDS Membership discount rate, able to view on-line the NDS Winter Bulletin and NDS Summer Annual which are produced once a year.
  • Option to receive a hard copy of the NDS Winter Bulletin and NDS Summer Annual which are produced once a year via post.
  • Receive an NDS membership card which will enable reduced entry to the two National Shows – Wisley and Harrogate for the Affiliated Society representative.
  • Can enter the Society classes of either of the two National Shows – Wisley and Harrogate.
  • For new Affiliated Societies joining after 1st August 2019 membership applies for twelve calendar months from the date of joining.
  • For existing Affiliated Societies who joined before 1st August 2019 membership applies for twelve calendar months from the 1st November each year.
  • Membership renewal e-mails will be sent.
  • Membership renewal can be either by Direct Debit or by credit card payment.
  • Can enter their Affiliated Society events, activities, photos, show schedule, society website url, on to a specific page on the Site to promote their activities associated with dahlias. Access to the specific page will be at our discretion. We are not liable for the accuracy of the information on the specific page.

    We reserve the right to remove, without notice, any Affiliated Society events, activities, photos from this specific page on the Site if we consider it to be inaccurate, offensive or against our overall aims and objectives.

3.2 Goods for Sale

By purchasing goods from www.dahlia-nds.co.uk you enter a legally binding agreement with us on the following terms. You should read and understand these terms because they affect your rights and liabilities. These terms describe the basis for purchase by you and sale by us of the products described on this web site.

3.2.1 Basis of the sale

An agreement for us to sell you Goods is made on these terms when we accept an order made by you via our Site. The description of the Goods, the price and delivery costs are set out in the order page. We will confirm acceptance of your request to order on-screen.

We aim to give you a clear idea of the nature of the Goods we sell. However, you appreciate that there are inevitably slight variations in size, shape and colour from what you see on your screen to the actual product. Illustrations, descriptions and other information is approximate and for guidance only. We may in our sole discretion from time to time vary the nature of the Goods from that advertised without notice to you, so long as these variations are not material alterations.

3.2.2 Details of the order

The quantity, quality and description of the Goods will be those set out in your order (if accepted by us).

Orders are accepted at our sole discretion but are normally accepted if the Goods are available, the order reflects current pricing, you are based in the Delivery Area and your credit or account card is authorised for the transaction.

The Goods which can be ordered via our Site are only available for delivery to you if you are based in our Delivery Area.

3.2.3 Price of the Goods

If the price of the Goods increases between the date we accept your order and the delivery date, we will let you know and ask you to confirm by e-mail that the new price is acceptable. If it is not acceptable then you will of course have the option of cancelling the order.

Our charges for transport and packaging are detailed on the order page and will be included in the total price for the Goods.

3.2.4 Payment terms

We will charge your credit / debit card for payment once we have confirmed the items you have requested are available and ready for despatch. If only part of your order is available, we will only charge for the items being sent in each shipment, with postage being charged on the first shipment. We accept no liability if a delivery is delayed because you did not give us the right payment details.

If it is not possible to obtain full payment for the Goods from your account, we can cancel the Contract or suspend any further deliveries to you. This does not affect any other rights we may have.

We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this Site, unless this is solely due to our negligence.

3.2.5 Delivery

We will deliver the Goods to the address you specify for delivery in your order. It is important that this address is accurate. We cannot accept any liability for any loss or damage to the Goods once they have been delivered in accordance with your delivery instructions.

We will aim to deliver within the quoted time frame but delivery times are not guaranteed. If delivery is delayed due to any cause beyond our reasonable control, we will contact you to advise you that the delivery date will have to be extended.

3.2.6 Risk and ownership

Risk of damage to or loss of the Goods passes to you at the time of delivery to you or, if you fail to take delivery at the agreed time, the time when we tried to deliver. You will only own the Goods once they have been successfully delivered and when we have received cleared payment in full. Goods supplied are not for resale.

3.2.7 Returns / Options to cancel

At the NDS we guarantee only to send you top quality products and will do our best to inspect everything carefully before it leaves us to make sure it’s in excellent condition. We also do our utmost to package and protect everything so that it doesn’t get damaged on its way. However, if you do have a problem, here is what to do:

3.2.7.1 Incorrect Goods

If you have received something you hadn’t ordered please contact us within 14 days informing us of the problem and we will advise what to do. Please make sure you keep the item in its original condition until we have advised what to do.

3.2.7.2 Damaged in Transit

If your purchase is damaged in transit, please contact us within 14 days informing us of the problem and we will advise what to do.

3.2.7.3 Damaged or Defective Goods

If you receive a product that is defective, please contact us within 14 days informing us of the problem and we will advise what to do.

3.2.7.4 Cancellation

Under the distance selling regulations you have the legal right to cancel your order within 14 working days of receipt of your order. To cancel an order, please contact us using the details above with details of the order you are cancelling. A charge may be made if the cancellation is done after the order or a part of the order has been despatched.

3.2.7.5 Return or Exchange

If for any reason you are not delighted with your purchase, you can return it unused and in the original packaging within 21 days for a full refund or replacement. Your statutory rights will not be affected. If you need to return an item please be aware that until we receive the goods you are returning, they are your responsibility. For your protection and peace of mind, we recommend you use a recorded delivery service to return things.

Goods must be returned at your cost (unless faulty or the incorrect goods were received). If the item has been damaged, used or is not returned in its original packaging, we reserve the right to withhold a percentage of the refund value if the item needs to be reduced in price for resale.

3.2.8 Warranties

We aim to provide high quality products to our customers. Accordingly, we warrant that where the Goods are products and not already covered by a manufacturer’s guarantee, they will meet their specification and will be free from defects in materials and workmanship at the time of delivery.

3.2.9 Liability

If you have a valid claim in respect of any of Goods which is based on any defect in their quality or condition or their failure to meet specification in accordance with the Contract, and you have returned the Goods within a reasonable time, you will be entitled to choose either a refund of the price of the Goods or replacement Goods free of charge.

We shall not be liable to you for losses you suffer based on the estimated delivery date of an order should these items fail to be delivered within that time.

These terms and conditions do not affect your statutory rights as a consumer.

We will continually improve the Goods, so changes to them may be made at any time. We will use reasonable commercial endeavours to keep the Site up to date but the information and specifications given are for your information only and are subject to change without notice.

Great care has been taken to ensure that all Goods are accurately described. Dimensions are approximate only. Great care has also been taken with all the images on this web site, however the actual colours you see will depend on your monitor and could vary from the actual product.

The content of the Site is directed solely at those who access the site from addresses within the Delivery Area.

We assume no responsibility for the contents of any other web sites to which this Site has links.

3.2.10 Matters out of our control

We will not be liable to you or in breach of the Contract for delay or failure to perform due to a cause beyond our reasonable control.

All of the written, photographic, design and audio content of the Site together with the selection and arrangement of it and all software compilations are our copyrighted property or that of the people who have granted to us the right to use it and is protected as such. All rights reserved.

None of this material may be used without our written permission. You may download or print a single copy for your own non-commercial off-line viewing.

All names, logos, slogans, or other phrases may be a trade mark of ours or another person or corporation. Any unauthorised use of a trade mark is unlawful.

5. Privacy

To the extent that any provision of these terms is found by any court or competent authority to be invalid, unlawful or unenforceable in any jurisdiction, that provision will be deemed not to be a part of these terms, it will not affect the enforceability of the remainder of these terms nor will it affect the validity, lawfulness or enforceability of that provision in any other jurisdiction.

The headings in these terms are for convenience only and will not affect their interpretation.

The Site may contain links to third-party websites (‘Other Sites’) that are not under NDS control. The NDS makes no claim and accepts no responsibility regarding the quality. These terms will be governed by English law and any disputes will be resolved exclusively by the English Courts.
